We offer this website, including all information, tools, and services available from this site, to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here. By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following Terms of Use, including those referenced herein or available by hyperlink. These Terms apply to all users of the site, including browsers, customers, and contributors of content.

Please read these Terms carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms. a. Products. All features, content, availability, specifications, and prices of products described on this site are subject to change at any time without notice. Certain products may have limited quantities and are subject to our Return Policy. The inclusion of a product at a particular time does not guarantee its future availability.

b. Accuracy of Content. Weights, measures, and similar descriptions are approximate and provided for convenience. We make every reasonable effort to accurately display our products, including scent descriptions and imagery, but colors and details may appear differently depending on your device display. We cannot guarantee that any description is fully complete, accurate, or current. In the event of a pricing error, we reserve the right to cancel any affected order.

c. Account. If you create an account with us, you agree to provide accurate, current, and complete information, and to keep that information up to date. We reserve the right to suspend or terminate an account based on inaccurate or incomplete information. By providing your contact information, you consent to receive communications from us about your order or, where you've opted in, our products and promotions. You may opt out of marketing communications at any time; administrative communications such as order confirmations will still be sent.

d. Shipping. Orders are shipped to the address you provide, in accordance with our Shipping Policy.

e. Confirmation, Cancellation, and Promotions. An order confirmation email does not guarantee our acceptance of that order. We reserve the right, without prior notice, to limit order quantities, discontinue a product, decline to fulfill an order, or place conditions on any promotional code.

f. Candle Safety. Our candles are intended for use as directed. Always burn candles within sight, on a heat-resistant surface, away from flammable materials, drafts, and out of reach of children and pets. Trim wicks to ¼ inch before each burn, and never leave a burning candle unattended. Pulchra Home & Candles is not responsible for injury, property damage, or loss resulting from improper or unsupervised use.

g. Site Rules. You agree not to: copy, scrape, or redistribute any part of this site; use automated systems to access the site; transmit spam or unsolicited communications; attempt to compromise site security; upload harmful code; collect personal information about other users; impersonate any person or entity; or otherwise interfere with the proper functioning of the site.

2. Proprietary Rights

All content on this site, including images, text, graphics, logos, and product designs (the "Pulchra Content"), is the exclusive property of Pulchra Home & Candles and its licensors. You may not sell, license, distribute, reproduce, or create derivative works from any Pulchra Content without our written permission. These Terms do not grant you ownership of any Pulchra Content, only a limited right to use the site as intended.

3. Payment

We use a third-party payment processor to handle transactions. Processing of payments is subject to that processor's own terms and privacy policy in addition to these Terms. We are not responsible for errors made by our payment processor.

Our privacy practices are governed by our Privacy Policy, available on this site. Our Privacy Policy does not extend to the practices of any third parties we do not own or control.

We take commercially reasonable measures to protect the site and your personal information from unauthorized access, use, or disclosure. However, we cannot guarantee that unauthorized third parties will never defeat these measures. You provide your personal information at your own risk.

We do not warrant that the site will be uninterrupted, secure, or error-free. If you are dissatisfied with the site or any product purchased through it, your sole remedy is to discontinue its use.

9. Limitation of Liability

To the maximum extent permitted by law, Pulchra Home & Candles and its owners, agents, and employees are not liable for any indirect, incidental, special, or consequential damages arising from your use of the site or its products, even if advised of the possibility of such damages. Our total liability to you for any claim will not exceed the amount you paid us for the product(s) giving rise to the claim, or $100, whichever is greater. Some states do not allow the exclusion of certain damages, so these limitations may not apply to you in full.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles. Any claim arising out of or related to these Terms must be filed within one year of when it arose, or be forever barred. Any dispute that cannot be resolved directly will be brought exclusively in state or federal court located in Essex County, New Jersey.

These Terms remain in effect unless terminated by you or us. You may stop using our site at any time. We may suspend or terminate your access to the site at our discretion, including for violation of these Terms, without prior notice.

We respect the intellectual property rights of others.
